Michael Cassel Group Pty Limited, ABN 27 082 690 638 (MCG, we, our, us) is bound by the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs) (and any amendments to them).

We are committed to the protection of your personal information. 

This policy explains how we collect, store and use your personal information, as well as our obligations and your rights in relation to your personal information. By providing us with your personal information, you consent to our collection, storage, use and disclosure of your personal information as set out in this policy. 

This policy also applies to your personal information that we collect in connection with any live theatrical and/or musical events that we produce or present in Australia (Shows) which have their own websites that link to this policy and specifically refer to this policy applying.

What personal information we collect

We collect different types of personal information depending on your interactions with us, such as your name, contact details, gender and age.  We do not collect ‘sensitive information’ about you.  We also collect data that does not personally identify you from other means such as by the use of ‘cookies’.

How we collect your personal information

We collect personal information directly from you and, with your consent, from other businesses that we work with (Associates).  You do not have to provide your personal information to us but if you do not, we may not be able to provide you with all the services you want.

How we use your personal information

We collect and use your information for many reasons such as promoting, and selling tickets to, our Shows, contacting you to share news and, where you have agreed to receive it, for marketing purposes, as well as where required by law.  We will not use your information without your consent.

Who we share your personal information with

We do not sell your personal information.  We may share your personal information with our Associates as necessary and service providers (including those based overseas).  If we do, we require the recipients to hold your personal information securely and to only use it for the purpose for which it was provided.

How we protect your personal information

We store your personal information securely and delete it when it is no longer needed, but we cannot guarantee it will be secure at all times.  Please contact us immediately if you think there has been unauthorised use of your personal information.

Your choices and rights

Among other rights, you can choose whether to receive marketing communications from us. You also have the right to: request a copy of your personal information; and request us to amend or delete the information we have about you, which we will do if it is reasonable for us to do so.

DETAILS OF THIS POLICY

1. WHAT PERSONAL INFORMATION WE COLLECT

We collect information that may be used to identify you if it is reasonably necessary for our functions and activities (see section 3 below).  This may include your name, contact details (such as your postal address, email address and phone number), gender, age and billing information.

We do not knowingly collect ‘sensitive information’ about you without your consent.

We also collect data that does not personally identify you through technology embedded in our websites, emails and third party sites or platforms, which includes applications known as ‘cookies’ that follow your interactions with our websites.  While cookies allow a computer to be identified, they do not permit any reference to a specific individual. The information we collect includes usage, viewing and technical data including your device identifier or IP address and the length of time you spend on our websites.  Your browser should allow you to refuse cookies if you desire, although you may not be able to use some features of our websites if you choose to do so.

2. HOW WE COLLECT YOUR PERSONAL INFORMATION

We collect personal information directly from you when you provide it to us, including when you:

(a) subscribe to our mailing lists, complete a form or survey, or enter a competition we operate;
(b) connect with us via any of our social media platforms; and
(c) contact us including via our websites or by telephone or email.

We may also receive your personal information from Associates, provided you have consented to them disclosing it. For instance, this includes personal information that you provide to venues and ticket sellers when you acquire tickets to our Shows. This policy applies to our receipt of your personal information from our Associates.

3. HOW WE USE YOUR PERSONAL INFORMATION

We use your information (including your personal information and non-personal information) for the primary purpose for which it was collected or to which you consent. We may also use it for any other purpose related to the primary purpose where you would reasonably expect us to do so, or if we have otherwise received your consent. We may obtain your consent explicitly, such as when you confirm a checkbox, or implicitly from the context in which we collect your personal information, such as when you contact us and request a response.

The reasons for which we may use your information include:

(a) Tickets: to provide or sell you tickets to Shows.
(b) Competitions: to contact you in relation to any competitions that we may operate from time to time and which you enter.
(c) Contact: to respond to your queries, fulfil your requests, provide you with goods or services and confirm details.
(d) Social media: to connect with you via social media platforms. We may use third parties to assist us in this process.
(e) Improve your experience: to enhance our websites, your use of the websites and to conduct market research and analysis. We may also aggregate your personal information with that of other users for the same reason.
(f) Marketing: where you have given us your consent, or it can be reasonably inferred from your conduct, to send you marketing communications and information that we believe you may be interested in such as information about future Shows, invitations to Shows and our latest news. We will always provide you with an easy way to opt out of direct marketing we send you. We may use non-personal information such as ‘cookies’ to send you targeted advertisements on third party sites, including social media sites.
(g) Business purposes: any other business function that is implicit in the way we collect your personal information.

4. WHO WE SHARE YOUR PERSONAL INFORMATION WITH

We do not sell, licence or rent your personal information to others.

We may share your personal information with our Associates as needed to provide the functions in section 3 or as required or permitted by law.  This includes Associates which provide goods and services to you (such as ticketing companies) and which provide publicity, promotion and marketing services.  If we do, we require our Associates to hold your personal information securely (see section 5) and to only use your personal information for the purpose for which it was provided.

We may also share: your personal information with any successor to all, or part, of our business; and aggregated and de-anonymised information with others to help us operate our business.

5. HOW WE PROTECT YOUR PERSONAL INFORMATION

Our staff are subject to obligations of confidentiality with respect to your personal information and we take reasonable measures to protect your personal information and to delete it when it is no longer required.  

We maintain appropriate security for our offices and information storage facilities so as to prevent any loss, misuse, unauthorised access, disclosure, or modification of your personal information.  However, we cannot guarantee that your personal information will be secure at all times.  Please contact us immediately if you think there has been unauthorised use of your personal information.  To the extent permitted by law, we exclude any liability for loss or damage caused by unauthorised access to and/or use of your personal information.

When we provide your personal information to others as permitted by this policy, we require that they maintain at least the same level of security, protection and confidentiality as we do.

From time to time we may engage an overseas recipient to provide services to us, such as cloud-based storage solutions.  The use of overseas service providers to store personal information will not always involve a disclosure of personal information to that overseas provider.  However, by providing us with your personal information, you consent to the storage of such information on overseas servers and acknowledge that APP 8.1 will not apply to such disclosures. For the avoidance of doubt, in the event that an overseas recipient breaches the APPs, that entity will not be bound by, and you will not be able seek redress under, the Privacy Act.

We may disclose personal information to our related companies, where permitted under the Privacy Act.  We currently have a related company in Singapore and may disclose personal information to that company. As at the date of this policy, we are not likely to disclose personal information to any other overseas recipients but if we propose to do so in the future, we will do so in compliance with the requirements of the Privacy Act.  We will, where practicable, advise you of the countries in which any overseas recipients are likely to be located.

By providing your personal information to us, you consent to us disclosing your personal information to any such overseas recipients for purposes necessary or useful in the course of operating our business, and agree that APP 8.1 will not apply to such disclosures.  For the avoidance of doubt, in the event that an overseas recipient breaches the APPs, that entity will not be bound by, and you will not be able seek redress under, the Privacy Act.

6. YOUR CHOICES AND RIGHTS

You have the following choices and rights when providing us with your personal information:

  • whether to receive marketing communications and information from us;
  • whether to use a pseudonym when dealing with us, however, we may not be able to provide you with some goods and services if you choose to do so;
  • to request a copy of your personal information however we may charge you a reasonable fee to provide you with this;
  • to delete, or request any correction to, your personal information, which we will do if it is reasonable to do so. If we do not, you may ask us to provide a written notice stating the reasons for refusing to do so.

We will respond to all requests for access to, or correction of, personal information within a reasonable time. Please be aware that our legal obligations must prevail over any of your choices or rights as set out above.

7. CHANGES TO THIS POLICY

We reserve the right to change the terms of this policy from time to time. An up-to-date copy of our policy will be available on our websites. Therefore you should check this policy whenever you use our websites.

8. OTHER SITES

This policy does not apply to other sites and services that are not operated by us, even if there are links to them on our websites.  You should check any relevant policies in respect of those sites and services before using them. This policy does apply to websites for our Shows if they link back to this policy and specifically refer to this policy applying.  By using our websites, you will be accepting this policy and therefore if you do not agree with this policy, please do not use our websites.
